DOT OSP License Registration

According to the Terms and Conditions formulated by the Telecom Commission in February 2000, OSP’s can take telecom resources from authorized Telecom Service Providers only and should not provide switched telephony. Further, the Department of Telecommunication must register OSPs using telecom resources for providing many services like a call centre, telebanking and other IT-enabled services. Therefore, the Department of Telecommunication (DOT) now registers OSPs in India and has registered over 2500 cases since inception.

Term for which License is Issued

Once Issued OSP License shall be valid for a period of 20 years which can be extended upto 10 years at the time of renewal.

Documents Required for OSP License are as Follows

In regard to the DOT OSP Registration, following documents are needed:

  • Memorandum & Articles of Association (MOA and AOA).
  • Certificate of Incorporation issued by Registrar of Companies.
  • Resolution from The Board of Directors.
  • Power of Attorney duly notarized authorizing the signatory with attested signature.
  • List of Present Directors of the company with Name, DIN, Address.
  • Present shareholding pattern of the company (indicating Indian Equity & Foreign Equity).
  • Network diagram - the OSP must clearly mention in the diagram whether it is using Sharing of Infrastructure or Centralized EPABX architecture or the CUG facility. Any change in the network is also required to be intimated immediately by the OSP without any delay.
  • If interconnection of either one international OSP centre (Company A) with another international OSP centre (Company B) of Group companies is required. If so, whether in case group companies the following documents have been submitted.
  • Shareholding pattern of one international OSP centre (Company A).
  • Shareholding pattern of another international OSP centre (Company B).
  • Certificate from statutory Auditor of the company to certify that one international OSP centre (Company A) & another international OSP centre (Company B) are Group Companies.
  • Other supporting documents, if any like balance sheet, annual report etc. to establish that international OSP centre (company A) & another international OSP centre(company B) are Group Companies.
  • If interconnection of either one domestic OSP centre (Company A) with another domestic OSP centre (Company B) of Group companies the following documents have been submitted.
  • Shareholding pattern of one domestic OSP centre (Company A).
  • Shareholding pattern of another domestic OSP centre(Company B).
  • Certificate from statutory Auditor of the company to certify that one domestic OSP centre (Company A) & another domestic OSP centre (Company B) are Group Companies.
  • Other supporting documents, if any like balance sheet, annual report etc. to establish that domestic OSP centre (company A); another domestic OSP centre(company B) are Group Companies.

Frequently Asked Questions

Can more than One DOT OSP Registration be obtained by the Company?

Yes, after receiving registration for one location, the OSP can apply for another location providing the OSP license of the obtained location and a copy of incorporation by ROC.

Is OSP Registration Transferable?

No. Transfer of OSP registration from one Private Limited Company to another is prohibited by the DOT.

When to submit the Annual Return after Registration?

After the completion of the Financial Year, the Annual Return is to be submitted within 6 months. The annual return must indicate the details of the activities of the previous financial year and the status of their continuing the OSP operation.

What if the Annual Return is not Submitted?

Those OSPs who do not submit the annual return for consecutive three years will be put in the dormant list and their registration will be canceled after keeping them for two years in the dormant list. Such a list would be made available on the DOT website.

What are the domestic OSP and International OSP and can they have interconnectivity?

OSP providing the application services within national boundaries is known as Domestic OSP. Whereas, OSP providing application services beyond national boundaries is known as International OSP. Interconnectivity is not allowed between them.
